Mulcahy LLP lawyers have extensive experience in counseling clients on a broad range of distribution issues, including price discrimination issues under the Robinson-Patman Act and vertical restraint issues under the Sherman Act and the Cartwright Act, as well as similar laws in other jurisdictions throughout the United States.

We have counseled clients and both pursued and defended lawsuits involving claims of price discrimination and secret rebates, discrimination in allowances and services and illegal inducement. We also have represented both sellers and buyers in claims of discriminatory treatment involving distributors or other customers.

We have worked with clients in the design of and modifications to their distribution systems. We have helped design promotional programs to be offered at different functional levels and have structured incentive programs that offer discounts and other benefits that encourage the promotion of our clients' products by distributors and dealers consistent with the Robinson Patman Act and related state statutes.

In addition to our counseling practice, we have handled lawsuits raising claims of unlawful vertical price and non-price restrictions, tying claims, dual distribution, dealer terminations and alleged unlawful horizontal conspiracies in violation of the Sherman Act and the Cartwright Act.
